About the Magnuson-Moss Warranty Act

The Magnuson-Moss Warranty Act (15 U.S.C. Sections 2301-2312) is a federal law that governs consumer product warranties, including vehicle warranties.

  • Full vs. Limited Warranties: Requires warrantors to clearly label warranties as "full" or "limited" and disclose terms in plain language.
  • Implied Warranty Protection: Prohibits disclaimers of implied warranties (merchantability, fitness) if a written warranty is offered or a service contract is sold within 90 days.
  • Lemon Law Integration: State lemon laws work in conjunction with the Magnuson-Moss Act. You can sue for attorney fees under Magnuson-Moss if you win a breach of warranty claim.
  • Who Is Covered: Anyone who buys a consumer product (including vehicles) that costs more than $5 and comes with a written warranty.
Key Strategy: Filing under both state lemon law and Magnuson-Moss gives you two legal theories for recovery. Magnuson-Moss allows recovery of attorney fees, which makes it easier to find a lawyer willing to take your case.
